IMPORTANT NOTICE: PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE BOOKING OR MAKING ANY PAYMENT. BY MAKING A PAYMENT FOR ANY TRAVEL PACKAGE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREED TO BE BOUND BY THESE TERMS.
1. PREAMBLE AND SCOPE
1.1. The Agreement: These Terms and Conditions (hereinafter referred to as “Terms”) govern the relationship between Kenpong Travel and Tours Limited (hereinafter referred to as “The Company”, “We”, “Us”) and the individual or entity purchasing or utilizing the travel services (hereinafter referred to as “The Traveler”, “You”, “Client”).
1.2. Scope of Service: These Terms apply specifically to travel packages, logistics, and services provided by The Company for the FIFA World Cup 2026 hosted in the United States, Canada, and Mexico (hereinafter referred to as “The Tournament”).
1.3. Binding Nature: Payment of the initial deposit or the full package price constitutes full and irrevocable acceptance of these Terms by the Traveler and all members of their traveling party.
2. BOOKING AND PAYMENT TERMS
2.1 Scope of Services: The services offered under each travel package, as publicised, shall constitute the full scope of services to be rendered by The Company to the Client. Any additional services requested shall incur additional charges that will be billed for upfront payment by the Client.
2.2. Confirmation of Services: A booking is considered provisional until the full package price has been received and cleared in The Company’s designated bank accounts. The Company shall ONLY commence the processing of travel documents, visa facilitation, and reservation of third-party services (flights/accommodation) upon receipt of the FULL package payment.
2.3. Payment Schedule:
2.3.1. Initial Deposit: The early bird deposit of GHS6,000.00 or USD500 does not constitute full payment of the travel package. The deposit constitutes a part of the full package price, and no confirmed bookings will be made unless the full package price is paid.
2.3.2 Refund of Initial Deposit: If the Client withdraws after paying the early-bird deposit, a maximum of 50% of the deposit may be refunded. Refunds will be calculated after deducting documented administrative costs and any non-recoverable third-party expenses already incurred on behalf of the Client.
2.3.3. Installments: If an installment plan is agreed upon in writing, the Traveler must strictly adhere to the payment deadlines.
2.3.4. Final Payment Deadline: All outstanding balances must be cleared no later than February 27, 2026. Failure to settle the outstanding balance by the stated deadline may result in cancellation of the booking. Any refund will be limited to the maximum amount recoverable from suppliers, after deducting reasonable administrative charges.
2.4. Price Fluctuations: Package prices are quoted in United States Dollars (USD) or its Ghana Cedi (GHS) equivalent. Where prices or fees are quoted in foreign currency (including USD), the applicable amount payable shall be the Ghana Cedi (GHS) equivalent, calculated at the prevailing interbank exchange rate on the date of payment.
The Company reserves the right to adjust GHS prices due to significant currency fluctuations or changes in third-party vendor costs (e.g., airline fuel surcharges, tax increases) prior to the receipt of full payment.
3. VISA FACILITATION AND DOCUMENTATION
3.1. Traveler Responsibility: It is the sole responsibility of the Traveler to possess a valid passport with at least six (6) months of validity beyond the date of return and sufficient blank pages.
3.2. Facilitation Service: The Company provides a Visa Facilitation Service to assist Travelers with the application process for US, Canadian, and/or Mexican visas. This is an administrative support service only which includes guidance on documentation and scheduling appointments where possible.
3.3. Accuracy of Information: The Traveler warrants that all information, forms, and documents provided to The Company for visa processing are true, accurate, and complete. The Company assumes no liability for visa refusals caused by false, misleading, or incomplete information provided by the Traveler.
3.4. No Guarantee of Visa: The granting of a visa is the sole prerogative of the respective Embassies, High Commissions, or Consulates. The Company DOES NOT and CANNOT guarantee the issuance of a visa.
3.5. Visa Denial Indemnity:
3.5.1. In the event of a visa denial by any Embassy (USA, Canada, or Mexico), The Company shall NOT be held liable.
3.5.2. Visa application fees paid to Embassies are strictly non-refundable.
3.5.3. If a visa is denied, the refund of the package cost will be subject to the Cancellation Policy outlined in Clause 4 of these Terms.
3.6. Security Vetting: The Traveler consents to background checks and vetting by The Company or relevant authorities to verify eligibility for travel.
4. CANCELLATION AND REFUND POLICY
4.1. Cancellation by the Traveler: All cancellation requests must be submitted in writing. Refunds will be processed based on actual recoverable amounts from third-party suppliers, less reasonable administrative charges, according to the schedule below:
More than 90 days before departure: maximum 60% of amounts paid 60–90 days before departure: maximum 50% of amounts paid Less than 60 days before departure: non-refundable
4.2. Cancellation Due to Visa Denial: If a Traveler is compelled to cancel due to a visa denial:
The Company will deduct an administrative fee of USD1,000 plus all non-recoverable costs incurred. The balance will be refunded to the Traveler.
The administrative fee of USD1,000 covers documentation processing, appointment scheduling, courier services, liaison with embassies, and staff handling time. Non-recoverable costs include airline deposits, hotel pre-payments, ticketing allocations, and any fees that suppliers do not refund.
The Traveler must provide official proof of visa denial to claim this partial refund.
4.3. Cancellation by The Company: The Company reserves the right to cancel any tour if the minimum number of participants is not met or due to Force Majeure. In such cases, a full refund of the package price (excluding visa fees already utilized) will be offered.
